• • Welcome to PegasusSwap. We appreciate your interest in our platform. This document outlines the terms and conditions governing your use of our services. Our goal is to provide clarity regarding your rights, responsibilities, and the nature of your relationship with us.
  • By accessing or using PegasusSwap, you confirm that you have read and agree to be legally bound by these Terms of Use, along with the applicable Fees and Commission Schedule available at pegasusswap.com.
  • The terms “PegasusSwap,” “Services,” “we,” “us,” and “our” refer to the platform and its managers. The terms “User,” “Customer,” and “you” refer to any individual or entity accessing or using the Platform.
  • For the avoidance of doubt, this agreement is strictly between you and the manager(s) of PegasusSwap.

• Important Notice

  • Please read these Terms carefully. They define your legal rights and obligations, explain the scope of services provided, and outline limitations of liability.
  • By accepting these Terms, you agree that any disputes arising out of or relating to your use of the Services shall be resolved exclusively through final and binding arbitration. You waive any right to bring such disputes before a court or jury.
  • If you do not agree with these Terms, you must discontinue use of the Platform.
  • Additional terms may apply to specific features or services.

• Definitions

  • For the purposes of these Terms of Use, the following definitions shall apply:
  • • “Platform” refers to PegasusSwap, including all interfaces, technologies, and services offered through the domain pegasusswap.com and any associated systems;
  • • “User,” “Customer,” or “you” means any individual or legal entity accessing, browsing, or otherwise using the Platform and its Services;
  • • “Manager” and “Support” refers to the individual(s) or entity responsible for operating and maintaining PegasusSwap;
  • • “Services” means all features, tools, and functionalities provided by the Platform enabling the exchange of Digital Assets;
  • • “Digital Asset” means any blockchain-based cryptographically secured digital representation of value, including but not limited to cryptocurrencies, tokens, coins, stablecoins, and other digital assets;
  • • “Coin” means a native Digital Asset operating on its own blockchain network (e.g., assets used to pay network fees or validate transactions);
  • • “Asset” means any Digital Asset supported by the Platform, including Coins and Tokens;
  • • “Token” means a Digital Asset issued on an existing blockchain network through a smart contract;
  • • “Swap” or “Exchange” means the internal transactional process initiated by a User through the Platform whereby one Digital Asset is exchanged for another. A Swap represents a service operation performed by the Platform and does not itself constitute a single blockchain transaction;
  • • “Blockchain Transaction” means a transaction recorded on a public distributed ledger network;
  • • “TXID” (Transaction ID) means the unique identifier assigned by a blockchain network to a specific Blockchain Transaction;
  • • “Deposit” means a Blockchain Transaction initiated by the User to transfer a Digital Asset to a deposit address provided by the Platform for the purpose of executing a Swap;
  • • “Withdrawal” means a Blockchain Transaction initiated by the Platform as part of completing a Swap, whereby the resulting Digital Asset is transmitted to the wallet address specified by the User;
  • • “Fixed Rate” refers to a Swap where the exchange rate is locked at the moment the Swap is created for a limited time window;
  • • “Floating Rate” refers to a Swap where the Swap rate is determined at execution based on current market conditions. Platform does not take the risks of market volatility;
  • • “Network Fee” refers to the fee charged by a blockchain network for processing a Blockchain Transaction, which is separate from any Service Fee and outside the Platform’s control;
  • • “Service Fee” means the fee retained by the Platform for facilitating a Swap;
  • • “Affiliate” means a third party promoting the Platform under a separate agreement;
  • • “Phishing” refers to fraudulent attempts to obtain sensitive information by impersonating the Platform;
  • • “Fake Token” means any Digital Asset imitating a legitimate project without a verified smart contract or authentic blockchain origin.

• Eligibility

  • By using the Platform, you confirm that:
  • • You are at least 18 years old;
  • • You have legal capacity to enter into binding agreements;
  • • You are using Digital Assets lawfully accessible to you;
  • • You understand the risks associated with Digital Assets;
  • • You will not use the Services for unlawful purposes;
  • • You are responsible for compliance with laws applicable to you.
  • The Platform may decline to process a transaction that violates these Terms or is technically incompatible with the system.

• Using the Platform

  • Swap Creation
  • You select the Digital Asset to send and receive. The Platform displays an estimated rate (fixed or floating).
  • Wallet Addresses
  • You must provide a valid recipient wallet address and may provide a refund address.
  • You are solely responsible for accuracy. The Platform cannot recover funds sent to incorrect or incompatible addresses.
  • Payment Instructions
  • After Swap creation, you receive a deposit address. You must send the specified amount using the correct network and required identifiers.
  • Timeliness of Deposit Payment
  • If funds are not received within the indicated time window, the swap may expire and be recalculated at the current rate or refunded after contacting our support.
  • Confirmations and Processing Time
  • Processing begins after required network confirmations. Timing depends on blockchain conditions and liquidity availability.
  • Finality
  • Once the output Digital Asset is transmitted to the provided wallet address, the Swap is successful.
  • Hybrid Operational Model
  • PegasusSwap operates under a hybrid transactional model.
  • The Platform does not provide traditional custodial accounts and does not maintain storage of user funds.
  • However, during the technical execution of a Swap, Digital Assets may temporarily pass through infrastructure controlled by the Platform or its liquidity partners for the sole purpose of completing the transaction.
  • The Platform may technically coordinate, route, and manage transactions to ensure execution, but it does not provide asset safekeeping services on behalf of Users.

• Fees and Exchange Rates

  • • Service fees are included in the displayed rate;
  • • Fixed Rate locks the rate temporarily;
  • • Floating Rate reflects execution-time market conditions;
  • • Network fees are outside Platform control;
  • • Minimum limits may apply;
  • • Fees and limits may be updated.

• Risk Disclosure

  • By using the Platform, you acknowledge:
  • • Digital Asset prices are volatile;
  • • Liquidity conditions may affect execution timing;
  • • Blockchain congestion may delay transactions;
  • • Incorrect wallet details may result in loss of funds;
  • • Transactions are irreversible;
  • • Regulatory frameworks may change.
  • You use the Platform at your own risk.

• Refund Policy

  • All exchanges are generally final.
  • Refunds may be considered in limited cases, including:
  • • Expired swaps;
  • • Technical processing errors;
  • • Unsupported or incompatible assets.
  • If approved:
  • • Funds are returned to the original sending address where technically possible;
  • • Network costs or rate differences may be deducted.
  • Refund approval remains subject to technical feasibility.

• Prohibited Uses & Security

  • You agree not to:
  • • Use the Platform for unlawful activity;
  • • Interfere with operations;
  • • Exploit vulnerabilities;
  • • Use unauthorized automation;
  • • Impersonate the Platform.
  • Users are responsible for verifying the official domain and avoiding phishing sites.
  • The Platform may decline or technically prevent transactions that compromise system integrity or security.

• Privacy & Data Use

  • Minimal Data Collection
  • The Platform does not require account registration for standard exchanges.
  • Data We May Process
  • We may process limited technical and transactional data necessary for:
  • • Completing exchanges;
  • • Providing support;
  • • Ensuring system stability and security.
  • If you contact support, you may voluntarily provide email or transaction details.
  • No Sale of Data
  • We do not sell or rent personal data.
  • Limited Disclosure
  • Data may be disclosed only:
  • Never. We do not store users information.
  • Security
  • Reasonable technical safeguards are implemented, though no system can guarantee absolute security.
  • Final Provisions & Liability
  • We strive to provide reliable service but cannot guarantee uninterrupted availability.
  • The Platform is provided “as is” without warranties of uninterrupted access or fixed financial outcomes.
  • Force majeure events, network failures, or external disruptions may affect operations.

• Amendments

  • These Terms may be updated at any time. Continued use constitutes acceptance of the updated version.
